Public Works
Director’s Report
I’m extremely proud of our Public Works Crews. They continue to step up to the challenges that come their way each day. As you will see below they have been quite busy taking care of the City streets, water and wastewater systems.
We are adapting to the new Springbrook accounting system as we go, getting used to new general ledger accounts numbers and classifications and working on tweaking the format for next year’s budget.
The proposed budget for 2014 is now being refined and should be available for City Council to review before the end of October. As part of this process we are also looking at the projected revenues to determine whether they will generate enough funds to meet upcoming debt service that starts in 2014.
Projects:
- Sheaff Avenue The construction between Springhill and Woodland Park Drive is approximately 17.4 % Complete
- Echo Lake Boulevard The construction between Highway 5 and I-30 is approximately 56.4% complete
- Drainage Projects West Pointe Phase III is complete. Forest Cove Phase II (Ashlea crossing) is about 65% complete
- Wastewater Treatment Plant The Plant is now complete and operational
- Manhole Rehab The rehab project is 80% complete
- Overlays The overlays on Springdale and Lori Lane are complete
- The AMI project is 96% complete but has experience unanticipated delays and is expected to be complete by December 31
- 12” Water Main to CAW The amendment to the DWSRF Facility Plan has been submitted to ANRC with along with an alternative 16” proposal
- Funding Request Numerous letters have been sent to ADTD, the Municipal League and Metroplan seeking funding assistance on various street projects
- Rate Analysis We submitted an inhouse rate analysis to the City Council on August 29, 2013 as required by city ordinance.
- Salvage Water Meters To date we have sold approximately $38,400 of the meter removed from our system for the AMI project. Salvage revenues will be dedicated to finishing the AMI project
STREET DEPARTMENT
- The Street Department has completed all Bridge Preventative Maintenance work that the State Inspector has requested the City to perform this year.
- We have started preparing for the upcoming winter months by cutting low hanging limbs on roads around the City to help eliminate any problems that might accrue if we have any ice or snow storms.
- Storm debris was a big issue this last quarter, several areas in the City was hit very hard with high winds. This is a job that takes a lot of effort and is very time consuming.
- Mowing has been consistent this last quarter with it being a time consuming project.
WATER DISTRIBUTION
- The water department helped in the Ashlea bridge project moving water lines and electrical conduit that were in the way of the drainage tiles. That saved the city approximately $5000 in contractors fees and helped speed things along.
- We also have had a lot of leaks related to the ground being dry for a long period followed by rains that made the ground shift causing breaks in water lines.
- We have had two 12 inch main breaks this summer. The City’s water crew had one of them cut out and repaired in only 3 hours.
- We have had around 1600 locates for the city so far this year.
- The fire hydrant project is near completion they have some touch up to do and a few hydrants to put extension kits on. This should be complete in October.
- The A M I project is coming to a close just some details to work out and a few larger meters to install .
- We have filled a position that was vacated in May,so we are back to a whole crew again and trying to catch up. I am hoping to get 2 or 3 new employees for 2014 to start another crew so we can better serve our customers and keep up with the growth of the City.

WASTEWATER COLLECTION
- Wastewater crews have completed about 335 work orders in the third quarter along with assisting water crews with many of their projects.
- While still focusing a lot of our attention on pump stations in 2013 we have reported a total of 5 SSOs for the third quarter of 2013.
- Project is about 95 % complete right now and should be done by the end of October.
- We have had a large reduction of I&I throughout the City with the most noticeable difference in basin 3 - Stivers Subdivision pump station. Example; A 2”rain event that last for a 24 hour period, typical run times for pumps is 22.5 hrs for a 24 hour period. Run times now average 2.5 hrs for the same amount of rain and length of time.
- Stagecoach Nursing and Rehab Center pump station is complete and on line.
- Owen creek pump station and Force Main: under construction.
- The Youth Service Center Force main Relocation is underway and should be complete by the end of the week or first of next week.
- Midland pumping station force main reroute project is in the planning and design stage.
- Shobe rd pumping station # 5 remodel is still in the planning and design stage also.
- Stone Hill estates has asked for and been approved final plat for phase 7 which will add another 187 sewer customers to the City of Bryant wastewater department.
- The odor issue in the 4000 blocks of Robinwood cir and Commonwealth Drive hopefully has been resolved. A large effort was made to resolve the issue, mains researched, cleaned, TV’d lines , Insituformed sewer main, relocated 1,300 ft of sewer force main and installed VFD’s ( variable frequency drives ) in station # 20 to control the discharge flow from the pump station.
WASTEWATER TREATMENT
- Avg. flow 1.437 MGD

Facility Maintenance:
- Secondary clarifiers have been isolated one at a time and pressure washed
Bldg. 5/ Inlet Works Structure
- Float switches have been added to influent EQ pumps to automatically operate when a high level in well is detected and pump to EQ basin.
- A horn and strobe light have been added as a notification of a high level in the wet well, this is controlled by a float switch.
Bldg. 6
- Cleaned auto drains and replaced filters for pneumatic air supply
Aerzen blowers
- #1 Aerzen changed oil and greased motor
- #2 Aerzen changed oil and greased motor
Bldg. 11
- Changed oil, greased bearings in sutorbuilt blower, changed air filter
1MGD process:
- Changed filter, changed oil and greased bearings on Kaeser blowers
- Replaced all air lines for pneumatic valves operating RAS and basin air flow controls
- Replaced seven solenoid valves for pneumatic valve controls
- This system was having issues with water seeping into one of the airlines under water and getting blown back to the solenoid control. The water was shorting out the electrical control of the valve and it would stick in an open or closed position. We have not had any issues since replacing this system
Waste Hauler Information:
- We have taken over 1,018,500 gals of lechate drain from the landfill this quarter and received payment of $50,925.00
Analysis Results:
- All weekly results from this quarters analysis were in compliance.
- The 3rd quarter bio-monitoring sample was collected during the 3rd week of July, all analysis received a passing grade
Entergy Consumption:
- Entergy usage for the new motor control center looks to average about 55,000kw a month. This will cost around $4800.00 a month to operate the new equipment. The motor control center is on a separate meter from the rest of the facility but will still operate through the main generator in the event of a power outage. These numbers are an average of the first three months of operation so more info will give us a better idea of the increase we will see in our entergy usage.
Plant Operation:
- Construction at the treatment facility is complete. VEI Contractors have installed seven aerators in the eq basin, three flyght submersible pumps, and two Duperon bar screens. This has made a great improvement to the operation of our preliminary treatment process.
- We are able to control the amount of flow into the inlet process by diverting inflow from our main sub-station into the eq basin. This basin can then be throttled through into the preliminary process through the new gravity drain installed from the basin well.
- A few minor bugs have been worked out and the project was considered substantially complete on August 27, 2013. Therefore, the one year warranty will expire on August 26, 2014. All issues during this time period will be documented and repaired. A complete inspection will be performed a week before the expiration date to insure proper operation.
Code Enforcement, Permits, Inspections and MS4
Residential permits are still steady, we issued 28 for the quarter, Commercial permits are slow we only issued 2 new permits. We have concentrated a lot of our time this quarter on cleaning up properties that were out of compliance, we issued 131 citations, for unsightly or unsanitary properties, which include everything from, tall grass, abandoned vehicles, blocking of drainage ditch,excessive debris, health hazards, parking on sidewalks, and violations on the international property maintenance code.
We will be sending out Business license renewal letters next month and with our new iworqs program they can be renewed and paid for through a link on our city website. The link should be up on the website and ready to go by Monday November 11th.
I will be bringing forth an Ordinance next month for your approval to place liens on the properties that we paid to have cleaned up. All of these are foreclosed or abandoned properties that in most cases have gone back to a mortgage holder that has refused to maintain the property at all or at least enough to keep it in compliance.
MS4 Stormwater Department had a very busy and productive quarter also, as you can see from their report. I would like to clarify one item on the report. The drainage ditch restoration between #3 and #4 Neal Street was done at my request not the Police Chief as has been suggested by some. I requested this be done because during their water meter change out it was brought to my attention that this ditch drains everything South, which is all uphill of this area up to regions bank and the erosion was such that the water meters were exposed and sitting in the bottom of the creek, so I had the meters moved and the drainage ditch stabilized to correct this problem.

MS4 STORMWATER / COMMUNITY DEVELOPMENT
We maintained the City owned basins with regular mowing and debris removal. Also on routine work, we did stormwater inspections around town including Raymar North Bryant Boulevard, Springhill Road Extension, Skilled Nursing and various other home building sites. The road projects inspections were done on a weekly basis to ensure protection of waterways and state requirements. MS4 also mowed Town Center Property. We did manage to fit in some stormwater mapping. We are trying to get back on track with mapping this last quarter to satisfy ADEQ requirements and meet the deadline of July 2014. Approximately half of the city has been mapped which includes the vast majority of heavily developed areas.
Beyond MS4 duties, we helped out the Water Department for two weeks with meter installation due to the fact they were extremely short handed for a period. We also helped Street Department with some tree removal & limb pick-up on Mills Park Road near the park and on Shobe Road near Alcoa 40 Park.
Here are some of the special projects that we completed. We finished up the Wallace property with remaining requests that he had on his list including land repair and restoration which was extensive. I was able to have Mr. Wallace sign off on a written agreement to signify that the City had completed the project in its entirety. We also completed major silt removal project in Shoal Creek off of Boswell Road to help reduce the risk of flooding in that area including Rodeo Subdivision. Another project completed was ditch restoration on Neal street between 3rd & 4th Neal which included silt removal, fiber blanket placement and rip rap installation. In the third quarter we also successfully completed the project to improve drainage in Kings Crossing Park. This turned into a two step process due to unforeseen issues in existing 18 inch street drain under sidewalk. The final total cost to complete Kings Crossing project was approximately 14,300. MS4 performed SWPPP operations, yard restoration (packing dirt in lifts - sodding), complete inspection on a daily basis while Car-Son Construction provided the major installation work. We also managed all steps in planning Kings Crossing Project with the help of Les Price from Crist Engineering on both phases 1 and 2. The planning phase did require some field work. The money we saved on this was a $15,000 engineering fee for a formal engineering plan and an estimated $15,000 by finding a smaller more competitive construction company that allowed us to do some of the work ourselves. Total savings is estimated at $30,000. Another project we completed was slit removal at Hidden Creek Road Bridge in the Forest Cove waterway. We also cut down and removed two dead trees from the City property at the intersection of Raymar and Shobe Road South. Lastly we cleaned out a storm street drain and culvert off of Debswood Road south that had total blockage.
Here are some areas we did clean up in which includes overgrowth, debris and trash removal: Richland Park Basin, Stoneybrook (two basins), Creek that runs through Mrs. Monk's property that drains Richardson Place, creek that runs through Richardson Place Subdivision, Forest Cove creek area from Hwy 5 to I-30 service road south, creek area around bridge on Boswell Road West, Debswood Bridge area, creek in Carywood Subdivision, ditch off of Wagner Road, creek along South Prickett Road,
On the Planning Department side of my job I completed and submitted two entries for the City of Distinction Awards through Arkansas Business Magazine in the categories of Go Green/Sustainability & Technology Advancement. The entry work included preparing the outline and body of the paper along with four pages of supporting documentation for each entry. Both entries won first place in our appropriate population category. I also served on the Jump Start Project Team for the Revitalization of Original Bryant. My support to the team involved input during planning phase, composing and writing many of the sections within the application submittal, attending all of the planning meetings and helping with the final stages of editing leading up to the submittal. Finally, I managed the production of the monthly City Newsletter.
Human Resources (3rd and 4th Qtr Report)
3rd Quarter - Springbrook
The Human Resources Department is continuing to work alongside of the Finance Department with the implementation of Springbrook. In August, the first live payroll rolled out to employees. There is still numerous changes ahead in regards to Human Resources and Springbrook.
4th quarter - Continuing with the Springbrook update (accruals and year to date balances). HR is looking forward to the total HR conversion with Springbrook in 2014.
3rd Quarter - Positions
The Human Resources Department is working alongside of the Fire, Parks and Public Works Departments to rewrite and/or rate positions.
4th quarter - Continuing with the position rewrites and new positions with Fire, Public Works, Finance and Police.
3rd Quarter - Employee Health and Wellness Fair (EBF)
Invites have went out for the Fair and we have received numerous responses for vendors to attend. We are excited this year about several of the Cities Departments hosting tables and training at the Fair. This year we will also be incorporating a chili cook-off.
4th quarter - So excited that we had our Second Annual Health and Wellness Fair.
3rd Quarter - City of Bryant Wellness
Meet with AML to discuss incorporating a wellness policy into the City of Bryant. Was pleased to hear that after our discussion with our free membership to Bishop Park for employees, hosting a Employee Health and Wellness Fair, and other features offered throughout our Fair and Intranet site, the City of Bryant is already leaps and bounds ahead of other cities within the state. After speaking with the representative, he asked if could use Bryant as a model to go by and could also implement some of the same processes that we use regarding the Intranet.
Police
Since start of 3rd quarter we have focused on detecting and deterring crimes in neighborhoods and businesses.
We have conducted and participated in multi-jurisdictional task forces which included RX Drug drop off, drug interdiction, DWI task force, Warrant round ups.
We also made our presence known during the holidays to ensure everyone had a safe time.
Made several arrest in connection with increased area burglaries.
Made progress on our command unit and trailer.
we have also made progress on the start of the Police Department's Pole Barn for equipment to be stored and maintained.
We are still accepting application for police officer position to be filled next quarter is our goal.
Animal Control & Adoption Center
Report for 3rd Quarter 2013
From the Director:
In 1999, I completed a list of all of the goals I hoped to achieve for Animal Control within the next 15 years. I wasn’t asked to create this list, I did it only for myself as a way to hold myself accountable for the never-ending task of bettering the service my department gave to the Bryant citizens. At the time, I was the only one in the department, and there was no way I could have known how fast we would grow in such a short period.
Each time I sit down to complete the quarterly report for the Mayor, Council and our Citizens, I review the same list I wrote all those years ago and I check off those items which have been accomplished.
The first list consisted of 38 items, broken down by the timeframe in which I intended to see them through: 5 years, 10 years, 15 years. Over time, items have been added and removed, but I kept those first 38 items on the list as a reminder of my vision of the animal control department. Only 8 of those items remain unfinished. One of those: Listed in the 15-year plan, “Begin construction of a community dog park” is about to come to fruition, and (hopefully) right on time, in late 2014.
I cannot tell you how excited I am about getting so close to completing this goal. I had actually forgotten that the park was on my 15-year to-do list until I sat down to complete this report and re-checked all of the tasks that remain.
The satisfaction I feel cannot be expressed. As I enter into my 14th year with the City of Bryant, I am so proud to be a part of this amazing team. I can honestly say that I feel as excited and as eager to I take on my daily duties as I was then.
I know that the previous information is not normally a part of the quarterly report, but I wanted to express my profound gratitude for the support of the Mayor, the other Department Heads, the City Council and our Community for supporting, not only me, but our department.

Dog Park Committee
Committee has met several times during the quarter and have approved the following fundraisers: Bandanna Sales, T-Shirt Sales, and a Dog-friendly Masquerade Gala, to be held April 12th, 2014. Also, the board is meeting with area businesses and offering sponsorship opportunities for both the gala and the park.

The grant has neared conclusion. Final purchases under the grant and final reports will be going out this month.
Events this Quarter
Dog Days of Summer Car, Truck and Motorcycle Show was a huge success! We had nearly 50 vehicles participate and 3 vendors this year. We were delighted with turnout and had a great time with wonderful people.
The 3rd Annual Doggie Dunk at Mills Park Pool was another wonderful event that doubled as a small fundraiser for the Dog Park. We had another great year! About 16 dogs participated in the event this year, splashing and running around the pool at Mills Park.
Arkansas State Animal Control Association Fall Conference & Training Academy was held in Conway. Two Bryant officers gave presentations at the event this year, Tricia Power and Rebecca Fitch.
Legal
Pending litigation:
Pre-2012 Hall v. Cob. Was set for trial beginning April 9, 2013. Case was continued by motion of the Plaintiff’s attorney. Attempted negotiations to resolve, but parties remain far apart. The principal issue is $$. Plaintiff is demanding money, but the claim that remains after summary judgment does not allow for money damages. My office will continue to work closely with ARML in actively defending this case.
2012- Cob v. Global Telecom - Case is on hold pending the criminal case of State v. Christopher Barnes. There is no sense in expending money and energy at this point until the criminal case reaches a resolution. Criminal case was set for trial but had to be continued because of new counsel for the Defendant. It is set for trial sometime in the next several months, but I do not have the exact date at this point. Defendant Plead guilty with restitution order or 10 years in jail. I have moved to dismiss the case and Order was entered this week. Case is Closed.
2013- TND v. COB. Case went to hearing on April 18, 2013. Court ruled that TND is allowed to pursue MFRS as the land is zoned and approved for that use. Further, Court said that TND would have to follow the terms and conditions of the TND Plan. Through keeping the issue narrow, the City is not exposed to millions of dollars of liability, but is in a position to enforce the restrictions agreed to under the TND. Case is closed and no development plans have been formally presented.
2013- Oltmans v. COB - MFRS phase three construction. Again, the project was zoned and approved prior to enactment of the Moratorium. As expected, Court ruled that Oltman property was not subject to Moratorium as it was approved and building permit issued prior to moratorium going into effect. That case is resolved, with the Court ordering Oltman to follow its approved site plan. That any deviations from the plan could be considered a new application. The development has confronted several issues and DRC is working through those. Case closed, construction continuing, I do not know date of completion.
Pre 2012- Collins v. CoB - Case was decided in favor of the City in the Court of Appeals. Further, Plaintiff sought attorney fees from the Circuit Court. I along with retained counsel defended the city on that issue and the Court agreed that attorney fees were not available to the Plaintiff. Plaintiff’s attorney appealed that issue and the City counter-appealed on the issue of entry of judgment in favor of the City. That matter has been briefed and we are waiting for court to decide if oral argument will be necessary. Waiting on Ark. Supreme Court to take case or not.
2013- Collins v. COB 2 - Plaintiff filed a second case on the same issues as the prior case. The City has retained counsel through Municipal League. An answer has been filed and anticipate filing a motion to move case to the first case’s judge and then filing additional motions. Have been responding to numerous FOIA requests from Mr. Collins on this issue. Appears the focus is on money allocated to the project and timing of such.
Burdette v. CoB - Civil Rights case involving a non-physical arrest by officer Michael Turner. The City has retained ARML to defend Officer Turner and the City. The case is in the early stages of litigation. Case is settled, total city outlay was 5,500. (3,000 was ARML costs deposit).
Potential Litigation matters:
Dayco Construction. A settlement as to amount owed has been reached. I have received a verification from Dayco that it is aware of the two remaining leak issues and agrees to continue working to correct them. I have been in contact with several sub-contractors wanting to know when Dayco is paid the final amount. I anticipate requesting release of the funds within the next 10 days to resolve the remaining payment issue and avoid litigation. Open Aire is still giving grief and anticipate potential litigation or arbitration to resolve their unwillingness to honor their product.
Administrative matters:
Records Retention Policy - I have a working draft that needs additional tweaking. I have received input from several departments on the types and categories of documents they create and possess. This is an ongoing project for my office and will continue over next several months. Policy is nearly completed. Discussed budgeting with City Clerk for additional man power in fiscal 2014 to sort, scan and shred documents under policy terms. Will present to council in November most likely.
Working with departments in establishing procedures for Resolution and Ordinance creation and review of documents prior to being placed on agenda.
Am now part of the Agenda Center Workflow, thereby all documents have to come through me for Council. Thus I can decline an item if I have not had appropriate time to review the documents.
Multi-family Ordinance - Completed
Billboard Moratorium - Working with Code and Planning on moving this item forward to end the Moratorium and get clear rules in place.
Attending District Court once a month to observe court activities and try to identify any areas of improvement from the city prosecutor’s perspective. Developing a strong working relationship with the Judge in addressing common issues for the Court and City Hall.
Freedom of Information Act Requests:
Responded to and reviewed numerous FOIA requests from the public, media and other city officials. Also, the new web site FOIA form is working, where the requests come directly to me to send to appropriate department and check on compliance.
Finance Department
(for 3rd Quarter 2013)
- We continue to work on Utility Billing which was installed in late First Quarter. We are currently working to get Budget Billing with clear and concise details available to customers. AMI is allowing timely, much more accurate water meter reads, and enables the City to quickly detect water leaks and extreme usage in a very rapid manner to ultimately save our customers money.
- True statement billing is another feature that has been requested, which we are trying to implement as well.
- Online Web Payments is operational, and we will be promoting its features and advantages in the future.
- Phase I of “Going Green” is now available. Customers can opt out of receiving their paper water bill in the mail. Now the statement is available by email or online. We currently notice many customers are open to Online Web Payments, but they still desire to receive a paper statement as well. Communications and promotion will positively drive some customers to elect “Green”.
- Although the finance and payroll modules have been implemented during third quarter, the Staff is in the process of tweaking and making critical adjustments. Many of these adjustments include involving other department directors and staff to obtain their feedback, in order to hopefully deliver a much clearer and user-friendly financial product. Challenges are ahead as we work with each department in 2014 budget planning, since financial data is in two systems for 2013.
- Payroll processing, much like budget data is split between two systems. Finance is carefully testing and reviewing the numbers.
- Several other software modules will be implemented in early 2014, hopefully in a very orderly and cautious pace to minimize errors and frustrations. Most of these modules involve all the other departments as well.
- Sales Tax for the first four months of the year is 6% over 2012. We anticipate meeting or exceeding our budget projections for Sales Tax Revenue.
- The Finance Department is operating out of the newly remodeled facilities. We like the new look!
- Laserfiche implementation for the Finance Department is crucial for the efficient and accurate operation. We must quickly couple its operation with the new financial software platform.
- The new Finance Director began employment October 11, 2013 and with the awesome Finance Department Staff our goals must include accurate and timely financial reporting, clear, understandable, and transparent reporting and explanation of financial positions and progress, and an ability to make essential yet fast pro-active adjustments based upon current trends, economies, and circumstances. My initial days in the office, I have been amazed at the amount of man-hours being spent on FOIA request. Hopefully moving forward we can present information and create a much more transparent perspective to all interested parties. We are interested in developing easy access, like the Open Book site at the City of Fort Collins, Colorado

Bryant Parks and Recreation
1. Held Bryant Fest.
2. Held first movie at Mills Pool event.
3. Resurfaced gym floors.
4. Began first adult cooking class.
5. Finished out first karate class.
6. Met with several individuals to plan for upcoming adaptive programs.
7. Patio area between bathhouse and poolhouse is finished.
8. Held customer service training for Park Department emplyees.
9. Held meeting with Sub-Committee for five-year plan.
10. Won Governor Recycler of the Year from ARC.
11. Began enrolling fall activities.
12. Hosted Taste of Bryant.
13. Won Health & Fitness Club of the Year by the Governor Council on Physical Fitness.
14. Hosted Karate for Christ Tournament.
15. Partnered with LRPR Therapeutic Services for Adaptive Sports Sampler.
16. Mills Pool construction started 8/21/13. Demolition of the pool deck and mechanical room is completed. New skimmers were placed on 8/28/13. New water line installation is scheduled to start on week 9/9/13.
17. Won Salt Bowl-a-Thon and Won Swing for Saline Golf Tourney (fun activities within the activity that Parks Department participated in).
18. Turned in 50/50 matching grant to Arkansas Department of Parks and Tourism’s Outdoor Recreation Program.
19. Hosted Fall Fest.

DRC Staff discussed development proposals for the following:

- Proposed Transitional Home - 306 South Reynolds Road

- Midtown Apartments - Proposed apartments
- Raymar Fields (Geyer Springs Church)
- Cypress Valley Phase 2 Addition (currently in process of being annexed by the city)

- Arbor Creek Apartments - Jeremiah Oldman
The following rezoning request were approved by the Council
- Michael Bolin - R-X, C-1 and C-2 to R-1.S (7.8 acres south of Robinwood Drive, west of Henson Place).
Misc:
- Planning staff spent considerable time working with the Legal and Parks Department staff on the “Jump Start” Grant Application. The application was successful and city has been awarded a $200,000 Planning Grant From MetroPlan for the Old Town Bryant area.
